Terms of Sale

1. Identification of the Parties

1.1 The service provider

The website dad.pinc.be and the DAD (Digital Accessibility Directory) services are provided by:

1.2 The reseller (Merchant of Record)

Commercial transactions related to DAD’s paid services are processed by Paddle.com Market Limited, acting as Merchant of Record (official reseller). In this capacity, Paddle is responsible for payment processing, invoicing, collection of applicable taxes, and transaction-related customer support.

By purchasing a paid service through DAD, you enter into a purchase agreement with Paddle. The Paddle terms and conditions and the Paddle privacy policy also apply to your transaction.


2. Purpose

These terms of sale govern the purchase of paid services offered by DAD (Digital Accessibility Directory) through the Paddle payment platform.

By placing an order, you confirm that you have read and accepted these terms.


3. Description of Services

DAD offers the following services:

All prices are exclusive of VAT. The applicable VAT is calculated and collected by Paddle at the time of payment, based on your location.


4. Orders and Payment

4.1 Order process

Paid services are ordered through the website dad.pinc.be. After selecting the desired service, you are redirected to Paddle’s secure payment platform to complete your purchase.

4.2 Payment

Payment is processed by Paddle, which accepts the payment methods displayed during the checkout process (credit card, PayPal and other methods available depending on your location). Payment is due at the time of order.

4.3 Invoicing

Invoices are issued by Paddle in its capacity as Merchant of Record. You will receive your invoice by email after payment confirmation.

4.4 Audit on request

For expert audits (human testing), a quote is prepared in advance by Pinc Consulting. Payment is processed through Paddle in accordance with the terms agreed in the quote.


5. Delivery

5.1 Delivery timeframes

5.2 Delivery method

Accessibility statements and reports are delivered in digital format through your DAD account and/or by email. You will be notified by email when your deliverable is available.


6. Right of Withdrawal and Refunds

6.1 Right of withdrawal

In accordance with European consumer law, you have a right of withdrawal of 14 days from the date of your order.

6.2 Exception for digital content

DAD services constitute digital content. In accordance with Article VI.53, 13° of the Belgian Code of Economic Law (Code de droit économique) and Article 16(m) of Directive 2011/83/EU, the right of withdrawal can no longer be exercised once the deliverable (accessibility statement, report) has been made available to you, provided that you gave your prior consent to the performance of the service and acknowledged the loss of your right of withdrawal.

6.3 Refund policy

Refund requests are handled by Paddle in its capacity as Merchant of Record.


7. Nature of Services and Limitations

7.1 Automated audits

Automated audits detect accessibility issues identifiable by automated tools. They do not cover all WCAG 2.1 criteria and do not replace a full manual audit. Results are provided for informational purposes only and do not constitute a certificate of legal compliance.

7.2 AI-assisted audits

AI-assisted audits extend test coverage by using artificial intelligence to evaluate certain criteria that typically require human verification. Although more comprehensive than purely automated audits, they do not replace an audit carried out entirely by human experts.

7.3 Accessibility statements

Accessibility statements are generated based on the audit results available at the time of their creation. They reflect the accessibility status of the website on that date. Their accuracy depends on the absence of material changes to the website following the audit. We recommend an annual update.

7.4 Expert audits

Audits by human experts offer the most comprehensive coverage. The scope, methodology and deliverables are defined in the quote.


8. Intellectual Property

8.1 DAD website content

All content on the website dad.pinc.be (text, graphics, software, structure) is the property of Pinc Consulting SRL and is protected by copyright. Any unauthorised reproduction or use is prohibited.

8.2 Reports and statements

Accessibility reports and statements generated as part of a paid service are granted to you under a non-exclusive licence. You are authorised to:

  • Publish the accessibility statement on your website
  • Use the report internally to improve your website’s accessibility
  • Share the report with your technical service providers

Any resale or commercial redistribution of the reports is prohibited.


9. Liability

9.1 Limitation of liability

To the extent permitted by Belgian law, the liability of Pinc Consulting SRL under these terms is limited to the amount you paid for the service in question.

9.2 Exclusions

Pinc Consulting SRL shall not be held liable for:

  • Consequences of decisions made on the basis of audit results
  • The inability to achieve full compliance based solely on automated results
  • Changes made to your website after the audit has been carried out
  • Temporary service interruptions due to maintenance or circumstances beyond our control

10. Governing Law and Jurisdiction

These terms are governed by Belgian law. Any dispute relating to the interpretation or performance of these terms shall be submitted to the competent courts of Brussels, Belgium.

For transactions processed by Paddle, the Paddle terms and conditions may also apply.


11. Amendments

We reserve the right to amend these terms at any time. The version in effect is the one published on the website on the date of your order.
